Assignment Title: Selection of Consultant to Prepare Drafting Instructions for Environmental and Social Impact Assessment (ESIA) Regulations under the Physical Planning & Development Act

Saint Lucia has received financing from the World Bank toward the cost of the Renewable Energy Sector Development Project and intends to apply part of the proceeds for consulting services.
The consulting services (“the Services”) includes: (i) to review and make recommendations to amend the draft Environmental Impact Assessment (EIA) regulations in accordance with international good practice and; (ii) to prepare drafting instructions to enable the Attorney General’s Chambers to draft Environmental and Social Impact Assessment (ESIA) regulations to govern the ACT. The regulatory support is necessary for environmental protection and permissible socioeconomic development in the Green Buffer Zone (GBZ), including the conditions under which geothermal exploration and development would be permitted in this area.
It is estimated that the Service will require a level of effort 75 person-days, spread over a period of eleven (11) calendar months.

The Department of Infrastructure, Ports and Transportation now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are:
1. Qualification and Experience of the Firm.
A firm with the following minimum requirements:
- At least 5 years of experience operating as a Law Firm within St. Lucia;
- Demonstrated experience with the drafting of Laws of Saint Lucia and the process for enacting legislation.
- Demonstrated experience of operating within CARICOM and/or the OECS
Member States and working with International Institutions, including Multilateral Development Banks (MDBs), International Environmental NGOs, on similar assignments.
The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” November 2020 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms to enhance their qualifications but should indicate clearly whether the association is in the form of a joint venture and/or a subconsultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.
A Consultant will be selected in accordance with the Consultant’s Qualifications Based Selection (CQS) method set out in the Procurement Regulations.
The Government of Saint Lucia electronic procurement system shall be utilized to manage this procurement activity.
