Applications are invited from suitably qualified persons for appointment to the post of LEGAL OFFICER III, in the Department of Finance, Economic Affairs and Social Security (Inland Revenue Department).
RELATIONSHIPS AND RESPONSIBILITIES
1. Works under the direction and reports to the Comptroller of Inland Revenue.
2. Provides legal advice to the Comptroller and staff on matters related to taxation and the operations of the Department.
DUTIES AND TASKS
1. Reviews tax legislation, policies, procedures, handbooks and the other documents for legal loopholes and recommends amendments where necessary.
2. Prepares preliminary drafts and amendments to tax legislation, policies and regulations which are to be executed by the Department for submission to the Attorney General.
3. Assists the Enforcement Division in the investigation and prosecution of offences against tax laws.
4. Performs research on a variety of legal issues related to taxation and other areas of law requested by the Comptroller of Inland Revenue.
5. Prepares and vets deeds, contracts and issues and agreements in consultation with the Attorney General’s Chambers to ensure that the interest of the Department and, by extension, the Government of St. Lucia is protected.
6. Performs all legal services on behalf of the Comptroller except those reserved by law for the Solicitor General.
7. Attends all meetings with alleged tax offenders who seek administrative proceedings in lieu of litigations.
8. Assists in the collection and recovery of revenue through administrative means or court action and other processes laid open by law.
9. Defends appeals before the Appeals Commissioners against assessments made by the Comptroller of Inland Revenue.
10. Assists when appropriate in the preparation of cases to be submitted to the Solicitor General.
11. Investigates legal problems and gives advice or opinions on International and Bi-lateral Taxation Agreements, Conventions and Protocols.
12. Facilitates relevant training organized by the Inland Revenue Department on legal matters.
13. Performs other related work as may be assigned from time to time by the Comptroller of Inland Revenue.
14. Serves as the Chairperson/Secretary of the Department’s Legislative Review Committee.
CONDITIONS
1. Accommodation provided in a general administrative office.
2. Functions in a scheduled travelling post and will receive basic travelling and mileage allowance in accordance with the approved rates.
3. Required to maintain a motor vehicle for the effective performance of duties.
4. Institutional support is provided through appropriate Civil Service Regulations and Departmental Guidelines.
KNOWLEDGE, SKILLS AND ABILITIES
1. A sound working knowledge of the Laws of Saint Lucia, particularly the Income Tax Act and other Tax Legislation administered by the Department.
2. A working knowledge of and ability to interpret Legislation, Civil Service Rules and Regulations, Collective Agreements etc.
3. Ability to plan and organize work and prepare clear, concise reports.
4. Ability to analyze issues, collect data, establish facts and draw valid conclusions, and make sound recommendations.
5. Ability to effectively present information to management.
6. A working knowledge of computer applications and word processing software.
7. Decisiveness, soundness of judgment and clarity in issuing directives.
EVALUATION METHOD
Work performance will be evaluated on the basis of the following:
1. Timely completion of reports and meeting task deadlines.
2. Report quality as indicated by their clarity and accuracy.
3. Punctual and consistent attendance at meetings.
4. Number of problems investigated and relevance of recommendations submitted to solve those.
5. Compliance with departmental guidelines and standard operation procedures.
6. Effective implementation of tasks, responsibilities and assignments as defined in the job description.
QUALIFICATIONS
1. A Master’s Degree in Law, plus a Certificate in Legal Education with a minimum of one (1) year Legal experience.
Or
2. A Bachelor’s Degree in Law plus a Certificate in Legal Education, plus three (3) years Legal experience.
Preference will be given to candidates with experience in Legal Drafting, and who are familiar with the Income Tax Act and other Tax Legislation administered by the Department.
SALARY
Salary is at the rate of EC $73,541.06 per annum (Grade 17, step 1).
